About the Program

The objective of this program is to provide attendees with the tools necessary to identify common estate planning problems and opportunities for international clients with US connections. The program will consist of two parts. 

The first part of the program will review the rules for (1) classifying US and non-US individuals for estate planning purposes and (2) identifying US investments or activities that can create US tax, reporting and probate exposure for non-US individuals. This part of the program is intended to provide beginner and intermediate participants with tools for proactive issue-spotting.

The second part of the program will illustrate common estate planning pitfalls and opportunities for international families within the framework of several case studies, including (1) international families with a family member moving to the United States temporarily (for example, as a student) or permanently (for example, marrying a US person), and (2) international families with US real estate or portfolio investments. This part of the program will highlight planning opportunities and techniques that are better suited for intermediate participants.

About the Speaker

Ed Vergara acts as legal counsel to individuals, fiduciaries, and closely held businesses on a broad range of matters related to tax optimization and succession planning, with a primary focus on the design of tax-efficient ownership and transaction structures and the development of thoughtful mechanisms for the succession of ownership and control through transition events. A significant element of Ed’s practice consists of advising on cross-border matters. He often works with taxpayers managing changes of residency, including not only pre-immigration and expatriation planning for the United States, but also changes of residency and domicile between U.S. jurisdictions. Advising cross-border families and businesses is also an important part of Ed’s practice, and many of his engagements involve coordination with advisors in multiple jurisdictions to help clients manage tax, reporting and succession issues both in the United States and in the jurisdictions where assets or stakeholders reside.  Ed also often works with fiduciaries and beneficiaries of foreign trusts and foundations managing U.S. tax and reporting considerations.

Continuing Education

Continuing education credit is available at most webinars for Accredited Estate Planner® designees. In addition, a general certificate of completion will be made available for those professionals who feel the program satisfies their continuing education requirements and are able to self-file. It is the responsibility of the attendee to determine whether their state, discipline, or designation will allow one to self-file for a distance-learning program. Please contact webinars@naepc.org prior to attending your first program if you have any questions with regard to the availabililty of credit.
